IT CONTAINS VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS
WELL AS LIMITATIONS & EXCLUSIONS, THAT MAY APPLY TO YOU.
CONDITIONS OF SALE
These Terms of Sale apply between you and the Los Angeles County Department
of Coroner ("DOC") with respect to your purchase of DOC merchandise
("merchandise") from DOC’s website. These Terms of Sale shall
apply and may not be altered, supplemented, or amended by the use of any other
documents.
Sales from this Internet Site are limited to customers who are at least 18
years of age and who are residents of either the United States of America or
foreign countries supporting a minimum of 128 bit encryption.
DOC will NOT accept orders through this website from parties who are
underage or who intend to purchase merchandise for commercial resale. By submitting
an order through this website, you certify that you meet all of the requirements set forth in these Terms of Sale.
PAYMENT & ORDERS
Card payment, limited to Visa, MasterCard and Discover Card ("Cards")
is the only method of payment that will be accepted for merchandise orders through
this website. All orders received by DOC are subject to acceptance in DOC’s
sole discretion. Once accepted, DOC will attempt to fill your order for merchandise,
subject to available inventory.
Please note that in addition to the website, merchandise orders can be mailed
to the Skeletons in the Closet Store, 1104 North Mission Road, Room 208, Los
Angeles, California 90033. DOC also operates a Store where merchandise may be
purchased Monday through Friday, between the hours of 8:30 am to 4:30 pm PT
at the same address.
DOC is required by California law to collect sales tax for merchandise purchased
by residents of the State of California. If you are a resident of California,
you hereby authorize DOC to charge the applicable sales taxes to your Card.
SHIPPING
Shipping Charges: Shipping charges will be added
to your purchase based on the total weight of your order, including packaging,
and the applicable method of shipment. Weights listed for each item are approximate.
As you change the contents of your shopping cart, the Shipping
Fee will change to reflect your cumulative order. The Shipping
rates are subject to change at any time without notice.
Shipment Timeline: We generally ship our orders within 4 to 6 weeks from the
order date. Quoted shipping dates are based on estimates at the time of quotation.
DOC will use its best efforts to meet such shipping dates, but it shall not
be liable for any direct or indirect costs or damages, including without limitation
incidental or consequential damages, resulting from late deliveries.
Shipping Method
- Domestic Delivery
- Continental U.S., including DC:
- Standard shipping is via UPS Ground Service. Estimated delivery time is five (5) days.
- No shipping to P.O. Box addresses.
- U.S. Territories, AK and HI:
- Domestic delivery outside Continental U.S. will be limited to AK, HI and the following U.S. Territories.
- Other Domestic Territories:
No deliveries will be made to domestic territories other than Continental U.S., AK, HI and U.S. Territories specifically listed in 1(ii)(a) above.
- International Delivery
- Shipping to Canada will be made via UPS Canada Standard, UPS Worldwide Expedited, UPS Worldwide Express only.
- Shipping to foreign countries other than Canada will be made via UPS Worldwide Expedited, UPS Worldwide Express, UPS Worldwide Express Plus only to such foreign countries.
- Shipment to military addresses is not available at this time.
Shipping Fee Calculation
- Shipment weight in pounds (rounded off to the next higher pound) is used for shipping charges calculation.
- UPS Ground Residential Rate Schedule is used for shipping charge calculation for all domestic delivery within the Continental U.S., including D.C.
- UPS 2nd Day Air Rate Schedule is used for shipping charge calculation for non-Continental U.S. deliveries to AK, HI and U.S. Territories, where service is available.
- For international delivery, charges will be calculated by UPS based on the package weight, destination and the UPS Service selected.
PRINTING INVOICES
After you have submitted your order, you should print the Invoice from the
Invoice page by clicking on the print hyperlink embedded in the option to print
the Invoice for your records. By selecting the "print" option, you
will be taken into the Print Menu for selecting the printing criteria for your
Invoice, including an option to print the Invoice into a file. If you check
the box next to the "Print to file" option, the Invoice will be printed
into a file specified by you; otherwise, it will be printed on the attached
printer.
REFUNDS & EXCHANGES
You may return, exchange, or obtain a refund for, merchandise purchased from
the Skeletons website only as provided in these Terms of Sale.
All Sales Are Final! We do not accept returns or provide for cancellation of
orders. Refunds will be allowed only in the case of DOC’s error. Only
even exchanges, i.e. exchanges for identical items, will be allowed for damaged
or defective merchandise due to no fault of your own.
To receive a refund or enable an exchange, you must, within thirty (30) days
of the shipment date of the merchandise: (i) contact the Skeletons in the Closet
Store at (323) 343-0760 or e-mail us by selecting the Contact
Us option on the site; and (ii) if applicable, return the merchandise
in the original shipping container, along with the sales receipt, back to the
Store.
The refunds meeting the criteria of this Refund & Exchange Policy will
also include the Shipping charges. You will not be charged additional
Shipping charges for shipment of the replacement merchandise
in an exchange as provided herein. All requests for refunds and exchanges shall
be considered by DOC on a case-by-case basis.
INDEMNIFICATION & LIMITATION OF LIABILITY
To the extent permitted by law, DOC DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED
OR STATUTORY, INCLUDING THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR
PURPOSE.
DOC shall not be liable to you for any special, incidental, consequential or
punitive damages, or for any claim by any third party. You agree that for any
liability related to the purchase of merchandise, DOC is not liable for any
amount of damages above the aggregate dollar amount paid by you for the purchases
under this agreement.
CHANGES & ALTERATIONS
DOC reserves the rights to change prices, descriptions or other information
about the merchandise on this website at any time without prior notice. Although
DOC attempts to post accurate information, any errors by DOC regarding pricing,
description or other merchandise information are subject to correction by DOC.
DOC reserves sole discretion over the acceptance of orders, and may reject any
order that is not consistent with the requirements of this agreement.
JURISDICTION & VENUE
You agree that jurisdiction over and venue in any legal proceeding directly
or indirectly arising out of or relating to this agreement shall be resolved
exclusively in the appropriate state or federal court in Los Angeles County,
California where subject matter jurisdiction is proper. All such disputes shall
be governed by and construed in accordance with the laws of the State of California,
without regard to conflicts of state laws.
ENTIRE AGREEMENT
These Terms of Sale and the
Terms & Conditions constitute the entire agreement between DOC and you.
